WHAT IS MEDIATION?
The mediation process allows creative solutions to resolve issues without the necessity of going to trial.

A trial is a formal proceeding during which each side of a case challenges the other in an adverse manner, while trying to limit the evidence the judge may hear. Very strict rules apply and often the full picture of the situation is not allowed to be presented due to technicalities.

A mediator is an individual, who acts in an unbiased manner to help parties to resolve their difference outside of a courtroom. A competent mediator understands the basic facts, has sufficient experience to understand how the court will probably rule, and attempts to work out compromises between parties so that they can reach reasonable and fair compromises that work best for both parties.

WHAT ARE THE BENEFITS OF MEDIATION?
First: Emotions. Trials are very emotional and usually bring out the worst in everybody. Mediation can prevent the case from reaching that pinnacle.

Second: Respectability. In a trial, someone else makes the ultimate decisions, the Judge. At mediation, you must agree to the ultimate outcome. The process allows a forum for each side to compromise and save face.

Third: Time. Mediation allows for a quick resolution to be reached and in doing so, each party can move on with their life.

Fourth: Money. Trials as well as legal proceeding related to them such as motions, discovery and appeals are very expensive. Mediation allows a shortcut in reaching the ultimate resolution saving the parties money.

WHAT IF I ALREADY HAVE AN ATTORNEY?
The mediator is not you or the other party’s attorney but an independent unbiased person. The parties may or may not have their own attorneys

HOW DO I CHOOSE A MEDIATOR?
While everyone may be a mediator, the Virginia Supreme Court will only provide the title of a Certified Mediator to attorneys that have met their extensive training requirements. The mediator should have extensive legal experience in the type of case involved. In other words, you probably do not want a lawyer who spent their career handling real estate cases deciding a divorce. You want your mediator to be very experienced in your type of case and have the understanding and insight of how the Judge would probably rule.
